1. Purpose

EVOLUTICA LLC offers strategic consulting, software development, AI automation, digital marketing and corporate training services through its Academy unit.

2. Use of the site

The user agrees to make lawful use of the site, refraining from any conduct that could harm the image, interests or rights of the Company or third parties.

3. Intellectual property

All content on the site (text, images, logos, trademarks, code and design) is the property of EVOLUTICA LLC or its licensors and is protected by applicable intellectual property laws. Reproduction in whole or in part is prohibited without express authorization.

4. Contracting services

Contracted services are governed by the specific conditions agreed in the commercial proposal or contract signed between the parties, which prevails over these general terms in case of discrepancy.

5. Liability

EVOLUTICA LLC will not be liable for indirect damages, loss of profit or damages arising from the use or inability to use the site or its services, except in cases provided by applicable law.

6. Modifications

We reserve the right to modify these terms at any time. Changes take effect from publication on the site.

7. Governing law

These terms are governed by the laws of the Republic of Colombia. Any dispute will be resolved before the competent courts of the Company's domicile.

1. Identity of the data controller

EVOLUTICA LLC ("we", "the Company"), with legal domicile at 1414 W CHILTON AVE, GILBERT, AZ 85233, United States, is the controller of the personal data collected through this site (evolutify.co) and all its products and applications, including GENIA. As a Meta-verified Tech Provider and developer of AI and eCommerce solutions, this policy describes how we collect, use and protect information in accordance with third-party platform policies, specifically those of Meta Platforms, Inc. 2. Data we collect

• User-provided data: name, email, company and contact details.
• Browsing data: IP, device type, pages visited and cookies.
• Integration data (APIs): when you use our tools integrated with Meta (Facebook, Instagram, WhatsApp), we may access authorized data through the permissions requested in our applications.

3. Data usage and Meta permissions (API usage)

As a Tech Provider, EVOLUTICA LLC uses Meta APIs to deliver advanced functionality:

• WhatsApp messaging: access to whatsapp_business_messaging and whatsapp_business_management is used exclusively to manage customer communication and administer WhatsApp Business Accounts (WABAs) under the Tech Provider model.
• Transparency: we do not use data obtained through Meta APIs for purposes other than those specified in our application's functionality. We do not sell or share Meta user data with third parties for external advertising purposes.

4. Our applications and products

EVOLUTICA LLC operates under the commercial brand "Evolutify" and develops multiple software products. This Privacy Policy governs the data practices of EVOLUTICA LLC and all products listed herein, as well as any future products developed under the Evolutify brand or any other commercial name.

GENIA is an AI conversational agent platform, developed and operated by EVOLUTICA LLC under the Evolutify brand, that allows client companies to automate communication with their customers via the WhatsApp Business Platform. Data collected by GENIA includes: end-user WhatsApp phone numbers, message content and metadata (timestamps, message IDs), media files sent in the conversation, WABA and phone-number identifiers, and public profile information (public_profile) to authenticate dashboard access.

• Respond to information requests and commercial proposals.
• Deliver contracted services and follow up on the commercial relationship.
• Operate the GENIA AI agent and enable human intervention from the dashboard (Human-in-the-Loop).
• Send communications about our services, content or events (with consent).
• Improve the experience and performance of the website and our applications.
• Comply with legal and accounting obligations.

6. Legal basis

We process your data based on your consent, the performance of a contract, compliance with legal obligations or the legitimate interest of the Company.

7. Data sharing and processors

We do not sell your data. We work with the following technology providers, all located in the United States, to operate our services, including GENIA: Vercel Inc., Supabase Inc., Cloudflare Inc. and OpenRouter. These providers process data only on our behalf and under confidentiality and data-protection agreements.

8. Data retention

We retain GENIA conversation data during the active commercial relationship with the organizational client, and up to 12 months afterwards for support and audit purposes, unless the law requires a longer period. Other data is retained for the time necessary to fulfill the purposes described.

9. Your rights

You may exercise the rights of access, rectification, update, deletion, opposition and withdrawal of consent at any time by writing to hello@evolutica.co. We will process your request within a maximum of 30 days.

10. Cookies

We use our own and third-party cookies for analytics and functionality. You can configure your browser to block them, though this may affect the site experience.

11. Security

We apply reasonable technical and organizational measures to protect personal data against loss, unauthorized access or misuse. Data obtained through Meta APIs is handled in strict compliance with Meta's Platform Terms and Developer Policies.

12. Governing law

This Policy is governed by the laws of the State of Arizona, United States, legal domicile of EVOLUTICA LLC.

1. Scope of service

The scope, deliverables, timeline and price of each project are defined in a specific commercial proposal signed by both parties. Any change outside that scope is managed via a change request.

2. Communication and support

We maintain defined communication channels with each client (email, WhatsApp, recurring meetings). Post-implementation support is governed by the agreed plan.

3. Confidentiality

All information shared by the client is treated as confidential. We sign non-disclosure agreements (NDAs) whenever the client requires.

4. Payments

Payment terms are set in each proposal. Failure to pay may suspend service delivery until regularized.

5. Deliverable ownership

Final deliverables are transferred to the client once payment conditions are met. EVOLUTICA LLC retains ownership of its know-how, frameworks and internal tools used during execution.

6. Cancellations

Cancellation, refund and early-termination conditions are governed by the specific contract of each service.

7. Acceptable use

The client commits to using our services and platforms ethically and lawfully, without using them for fraudulent, illegal or policy-violating activities on integrated platforms (Meta, Google, etc.).
